Court Sacks PDP’s Ndudi Elumelu, Declares LP Candidate Reps Seat Winner

The Court of Appeal in Abuja has overturned the ruling of the National and State House of Assembly Election Tribunal in Asaba, which declared Ndudi Elumelu of the Peoples Democratic Party (PDP) as the winner of the last election in Delta State’s Aniocha/Oshimili Federal Constituency.

The appellate court declared Ngozi Okolie of the Labour Party (LP) the election winner in two decisions.

It criticised the tribunal for voiding Okolie’s election and then dismissed Elumelu’s petition before the trial tribunal on which the voided ruling was issued.

The Court concurred with Labour Party counsel Mahmud Magaji that, contrary to the tribunal’s findings, Okolie was lawfully nominated and sponsored by his party, and that he relinquished his assignment as a Senior Special Assistant to the Delta State Government as required by the Constitution.
