The villagers of Tudun Biri in Kaduna State’s Igabi Local Government Area have taken legal action against the Federal Government led by President Bola Ahmed Tinubu.
They are seeking N33 billion in compensation for the recent army airstrikes that resulted in the deaths of over 100 people in the area.
Many innocent people were mistakenly killed and several others were injured due to a Nigerian Army drone attack During a celebration of Mahlud in Tudun Biri village, Kaduna State.
In response to the incident, which occurred last Sunday night, President Tinubu has ordered an investigation and issued a warning that such a tragedy should not occur again. A lawsuit was filed on December 8th in a Federal High Court in Kaduna by Alhaji Dalhatu Salihu on behalf of the villagers of Tudun Biri.
The villagers, through their lawyer, Mukhtar Usman, Esq., are requesting an apology be published in at least three national newspapers.
The purpose of this lawsuit, as stated by the Daily Trust, is to protect the survivors’ fundamental right to life.
Among the reliefs sought is “a declaration that the act of striking dead, by way of aerial bombardment of the deceased victims herein while celebrating the Islamic Maulud at their village of Tudun Biri in Igabi Local Government Area on the 3rd day of December 2023 by the personnel under the command and supervision of the 3rd respondent (the Chief of Army Staff) amounts to a violation of the deceased victims’ fundamental rights to life as enshrined in Section 33 of the 1999 Constitution of the Federal Republic of Nigeria, 1999 and Article 10(1) of the African Charter on Human and Peoples Rights (Ratification Enforcement) Act (Cap 10) LFN 2010 and hence ultra vires the respondents, illegal, unlawful and unconstitutional.”
