The Supreme Court dismissed an appeal filed by Adegboyega Oyetola of the All Progressives Congress (APC), disputing the election of Ademola Adeleke of the Peoples Democratic Party (PDP) as Governor of Osun State.
In its decision, read by Justice Emmanuel Agim, the Supreme Court confirmed the Appeal Court’s decision, which upheld Adeleke’s election as state governor.
The Supreme Court ruled that the appellant failed to present sufficient evidence to establish his claim of over voting in the July 16, 2022 governorship election.
The decision was upheld and endorsed by all five members of the panel.
The appeal lacked merit, according to all the panel members.
The Independent National Electoral Commission (INEC) proclaimed Adeleke the winner of the election, claiming he received 403,371 votes to unseat Oyetola, who had received 375,027 votes at the time.
Oyetola and his party, on the other hand, claimed irregularities in the polls and contested Adeleke’s victory before the Tribunal.
On January 27, 2023, Justice Tertse Kume, who delivered the majority verdict, overturned Adeleke’s victory and declared Oyetola the winner of the election.
Justice Kume ruled that Oyetola received the majority of legitimate votes (314,931) against Adeleke’s 290,266.

But, dissatisfied with the verdict, Adeleke and the PDP appealed to the Court of Appeal, which, on March 24, overturned the Tribunal decision and declared Adeleke the winner.
Dissatisfied with the Appeal Court’s decision, Oyetola and the PDP went to the Supreme Court, which agreed with the Appeal Court and upheld Adeleke’s victory.
