Tribunal Affirms Ned Nwoko’s Victory, Orders Rerun In Warri South LGA

The petition submitted by Ken Kanmma of the Labour Party (LP) was dismissed by a three-member Tribunal presided by Justice Catherine Ogunsola for lack of merit.

The National and State Houses of Assembly Election Tribunal, sitting in Asaba, Delta State’s capital, has affirmed the victory of Peoples Democratic Party (PDP) Senator Ned Nwoko as the lawful winner of the Delta North Senatorial Election held on February 25, 2023.

The petition submitted by Ken Kanmma of the Labour Party (LP) was dismissed by a three-member Tribunal presided by Justice Catherine Ogunsola for lack of merit.

The Tribunal ruled unanimously that the petitioner failed to show his case since he did not present any essential documents to prove a case of non-compliance as stated in the petition.

In addition, the Tribunal dismissed a petition brought by Senator Peter Nwaoboshi of the All Progressives Congress (APC) against Nwoko. The Tribunal dismissed the case and awarded the petitioner N500,000 in costs.

In addition, in a case filed against the win of APC candidate Joel Onowakpo-Thomas over PDP candidate Michael Diden in the Delta South Senatorial District election, the court ordered the Independent National Electoral Commission (INEC) to hold a supplemental election within 90 days.

In their petition, Diden and his party asked the court to overturn INEC’s declaration of Onowakpo-Thomas as senator-elect, claiming that he “was not duly elected by a majority of lawful votes cast at the election and that his election was invalid due to non-compliance with the provisions of the Electoral Act, 2022.”

Among other things, the petitioners want the Tribunal to order a collation of the results of the election held in Warri South Local Government Area to the valid votes cast in favor of the parties and to announce the winner of the election based on the collation.

The Tribunal agreed with the petitioner’s argument and decreed a rerun solely in Warri South municipality, where the election was allegedly cancelled.
