Appeal Court Reinstates Yusuf Datti, Sacks Kwankwaso

The Court of Appeal in Abuja has removed Musa Ilyasu Kwankwaso of the All Progressives Congress (APC) and reinstated Yusuf Umar Datti of the New Nigeria People’s Party (NNPP) as winner of the Kura/Madobi/Garun Malam Federal Constituency Election.

The decision was made by a three-panel led by Justice Tunde Oyebamiji Awotoye, who accepted an appeal by Yusuf Datti.

The court stated that the tribunal made an error by considering the date of the appellant’s resignation as the date of his party’s primary election. Additionally, it was determined that Section 77 of the Electoral Act was misapplied.

The appellate court declared that no court has the authority to decide on the party’s membership issue.
